Description
Abstract : This article examines the Control of Tobacco Product Regulations 2004 – the ambiguities in certain provisions, the problem posed by illicit trade in tobacco product, the lack of specific regulations dealing with illicit tobacco product, the problem in defining a smoke-free area, labelling and packaging requirements that apply to ‘cigarette’ only and not to other tobacco product, and the policy of punishing individuals (including minors) who buy or have in possession tobacco product intended for personal use. Where applicable, comparisons are made with the Framework Convention on Tobacco Control and certain Australian legislation.
